What Changed on September 10

Sen. Cynthia Lummis released another revised CLARITY Act substitute ahead of the September 15 procedural vote. The announced changes address DeFi registration, the scope of DeFi provisions, credit-union participation, and other digital-asset issues.

The announced revisions do not identify restoration of House Title VI, the Anti-CBDC Surveillance State Act.

CBDC Language at Issue

The House-passed Title VI restricted direct Federal Reserve retail accounts, direct and indirect CBDC issuance, Federal Reserve testing, study, development, creation or implementation of a CBDC, and CBDC use for monetary policy. The Senate-reported substitute shows that title as deleted.

Current Federal Reserve Act Section 16A separately prohibits direct or indirect CBDC issuance or creation, but that provision ceases to be effective December 31, 2030.

CEA Action's Policy Objective

  • Restore House Title VI or materially equivalent permanent CBDC safeguards.
  • Cover both direct Federal Reserve retail issuance and indirect issuance through financial intermediaries.
  • Address direct retail accounts, CBDC development and implementation, and use of a CBDC for monetary policy.
  • Preserve private, open, permissionless financial innovation and meaningful financial privacy.

Key Vote Notice

CEA Action has identified the September 15 cloture vote as a Key Vote for tracking its policy priorities on economic freedom, financial privacy, and federal authority over digital currency. CEA Action's stated objective is restoration of House Title VI or materially equivalent CBDC safeguards during Senate consideration of H.R. 3633.

What Happens September 15

The scheduled vote is cloture on the motion to proceed to H.R. 3633, not final passage. If cloture is invoked, the Senate may proceed to consideration of the bill and amendments. The cloture motion is scheduled to ripen at 2:15 p.m. on Tuesday, September 15.
